Public Works - Encroachment Permits

Protecting the public right-of-way during construction is one of the primary responsibilities of the Public Works Department. All work performed in the public right-of-way requires an Encroachment Permit – this includes all utility companies (PG&E, SBC, San Jose Water, West Valley Sanitation District, Comcast, etc.). Examples of work requiring an encroachment permit include:

  • Traffic Lane and/or Sidewalk Closures (some routine maintenance activities exempted)
  • Construction of sidewalks, curbs, gutters and driveway approaches,
  • Installation of street lights, storm drains, water mains and services, fire hydrants and services, and sewer lines.
  • Installation of street trees

The encroachment permit is used to ensure that all work performed in the public right-of-way meets the City standards to protect the public and surrounding existing public facilities.

An R-1 Residential Encroachment Permit may be issued – one per year at a fee of $50.00 – to a property owner (owner occupied) to repair the sidewalk, driveway approach, or to place private improvements in the park strip located between the sidewalk and the curb in front of the property when the estimated cost of construction work is less than $10,000.00. Subsequent R-1 Encroachments Permits issued within a five-year period will be issued at a cost of $145.00 per additional R-1 permit.

In some cases, the City may also require a property owner to execute an Agreement for Installation of Private Improvements in the Public Right-of-Way.

Depending on the type of work being performed, a cash deposit or bonds may be required to ensure that the work done in the public right-of-way is completed in accordance with the City’s requirements.

Encroachment Permits typically require that contractors procure and maintain for the duration of the contract Insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work by the Contractor, his agents, representatives, employees, or subcontractors. Insurance meeting the City’s minimum Insurance Requirements must be in place prior to issuance of an Encroachment Permit.

Please note that all encroachment permits must be on the job-site at all times.
